Severability Clause

Mediation Clause
In the event of disputes arising from or in connection with this contract that cannot be resolved amicably, the contracting parties agree to engage a registered mediator (in accordance with the Austrian Civil Mediation Act – ZivMediatG) specializing in business mediation before initiating legal proceedings. The selection is made by mutual agreement from the list maintained by the Austrian Ministry of Justice.
If no agreement can be reached on the mediator or the subject of the mediation, legal or arbitration proceedings may be initiated no earlier than one month after the declared failure of the mediation.
If the mediation does not take place or is terminated, Austrian law shall apply to any subsequent proceedings. Necessary pre-litigation expenses – especially those for legal advisors involved in the mediation – may be claimed as costs in the subsequent proceedings.
